1. Agreement to Terms

By accessing or using Kolumbas ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

2. Description of Service

Kolumbas is a pigeon management platform that allows users to:

  • Record and manage pigeon information
  • Create and maintain pedigree records
  • Track breeding pairs and youngsters
  • Export pedigree documents
  • Import pedigree data from various sources

3. Account Registration

To use certain features of the Service, you must register for an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Be responsible for all activities under your account

4. Subscription and Payments

4.1 Free and Premium Plans

We offer both free and premium subscription plans. Premium features require a paid subscription as described on our pricing page.

4.2 Billing

Premium subscriptions are billed in advance on a monthly or annual basis. All payments are processed through our third-party payment provider (Stripe).

4.3 Cancellation

You may cancel your subscription at any time. Cancellation will take effect at the end of your current billing period. No refunds will be provided for partial billing periods.

5. User Content

5.1 Ownership

You retain all rights to the content you upload to the Service, including pigeon data, photos, and pedigree information.

5.2 License

By uploading content, you grant us a limited license to store, process, and display your content solely for the purpose of providing the Service to you.

5.3 Prohibited Content

You agree not to upload content that:

  • Violates any applicable laws or regulations
  • Infringes on intellectual property rights
  • Contains malicious code or viruses
  • Is fraudulent, false, or misleading

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service
  • Use automated means to access the Service without permission
  • Resell or redistribute the Service without authorization

7. Intellectual Property

The Service, including its design, features, and content (excluding user content), is owned by Kolumbas and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KOLUMBAS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

10. Indemnification

You agree to indemnify and hold harmless Kolumbas from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

11. Termination

We may terminate or suspend your account at any time for violation of these Terms or for any other reason at our discretion. You may terminate your account at any time by contacting us or using the account deletion feature.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page. Your continued use of the Service after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Kolumbas operates, without regard to its conflict of law provisions.
